Utah Supreme Court Responds After Affair Allegations Against Justice Released

A complaint filed in December 2025 with Chief Justice Matthew Durrant and the Judicial Conduct Commission details allegations that Utah Supreme Court Justice Diana Hagen “failed to promote confidence in the judiciary” because she was “improperly influenced by external relationships.”

ABC4 obtained records that show the complaint came from a lawyer in Provo who was told by Hagen’s ex-husband that she was having an affair with David Reymann, the lawyer for the high-profile congressional redistricting case.

The complaint suggests that Justice Hagen might not be able to be fair in the case because of the alleged affair.

Justice Hagen wrote a letter to the Utah Judicial Conduct Commission after hearing about the claims. Hagen strongly denies the claims of cheating, saying, “The suggestion that I was morally compromised while doing my official duties is completely false.”

Tobin Hagen, Hagen’s ex-husband, said in an interview on January 15, 2026, that he thinks the Justice had an affair with Reymann only because of the circumstances.

In a joint statement, Governor Spencer J. Cox, President J. Stuart Adams, and Speaker Mike Schultz stated that they plan to proceed with an independent investigation because the Judicial Conduct Commission and Court’s initial report left questions unanswered.

In response to the Legislature, the Democratic Leaders of the Utah Senate and House issued a statement voicing concerns that they are going beyond the bounds of constitutional procedures and the independence of the judiciary.

The Judicial Conduct Commission completed their investigation in accordance with their constitutional and statutory authority and dismissed the complaint against Justice Hagen.”

Additionally, they claim that the Judicial Conduct Commission’s records were “inappropriately released to the public” and that the complaint and its proceedings are legally confidential.

A spokesperson for the Judicial Conduct Commission said its chair, who is connected to the law firm involved, also recused herself. The commission declined to comment further on the matter.

State leaders did not provide a timeline for the new investigation. They also did not specify who would conduct the review.

Hagen was appointed to the Utah Supreme Court in 2022 by Cox. She previously served on the Utah Court of Appeals and worked in private practice and federal prosecution.
